Many in the know have said all along that the top FBI people will likely not see jail time because their jobs allowed them too much freedom and deniability. To convict someone of a crime they have to have broken a law, you have to have the ability to prove it in court, and a judge or jury has to convict them.
There are many other punishments that are highly effective however.
