It’s still not good, but the version of the legislation that passed requires a Commonwealth Attorney or Police Officer to file, random neighbor doesn’t cut it.
The burden of proof is on the Commonwealth and the standard is “clear and convincing evidence” not mere probable cause or even a “preponderance of the evidence.” It has to be “clear and convincing.”
