When RBG says it’s dead, it’s really dead.

In the early 80's the Supreme Court ruled women couldn't be drafted.
IIRC part of the argument against ERA was that it would make women eligible for the draft.

I get your point, but no one, not even Schlafly, can be fairly charged with failure for not preventing an adverse tide. Defeating the ERA was an important accomplishment in that as a federal constitutional amendment, it would have been a constant invitation to mischief as to gender and sexuality with little in the way of check or remedy. Legislation, state constitutional provisions, and bad executive policies on such issues though can be more easily reversed once the public recognizes their ill effects.

A Supreme Court (especially one still led at this time by John Roberts) that ruled Obamacare constitutional cannot be trusted under any circumstances, especially when still populated by Ruth Bader Ginsberg, to rule consistently and correctly on Constitutional matters.
When Ruth Bader Ginsberg has passed on, her word on anything can be trusted.
Until then, we have to be vocal and press constantly to prevent further degradation of Constitutional principles.

(Finding middle ground with tyranny or evil makes you either a tyrant or evil. Often both.)
