As i understand it, this dropped McCabe case would necessarily need to be tried in the DC circuit which is 90% D and almost impossible to find a balanced jury, as just happened with Stone's jury.
Whereas several other charges with which McCabe could be charged, occurred in DC and other locales and could be filed outside the district.
