Judge Andrew Napolitano: Despite his impeachment trial acquittal, Trump clearly guilty of a high crime
Fox News ^ | February 5 2020 | Judge Andrew P. Napolitano

Posted on 02/05/2020 11:20:10 PM PST by knighthawk

The Senate impeachment trial of President Trump ended not with a bang but a whimper. What different outcome could one expect from a trial without so much as a single witness, a single document, any cross-examination or a defendant respectful enough to show up?

Law students are taught early on that a trial is not a grudge match or an ordeal; it is a search for the truth. Trial lawyers know that cross-examination is the most effective truth-testing tool available to them.

But the search for the truth requires witnesses, and when the command from Senate Republican leaders came down that there shall be no witnesses, the truth-telling mission of Trump's trial was radically transformed into a steamroller of political power.

The ruling class really looks at us as morons.

The media sure think we are, and the "rulling class" are the one's who believe the media. So who's stupid, really?

It’s been 25 years since Napolitano has been a judge. He has apparently forgotten everything he ever knew about the law.

He should never be called “judge”. “TV personality” would be more appropriate.

Good God, how can so many people be so ignorant as to not see what just took place in Congress?

The only high crimes and misdemeanors committed were by each member of Congress that voted for impeachment and conviction of a president that committed no actual crimes.

Every Senator and Representative who did this has demonstrated they do not represent law and order! They have each violated their oath of office and broken actual law outlined in our Constitution regarding impeachment! Their actions are a very real abuse of power and every member of Congress who did this should be removed from office, immediately!

That more than half of Congress helped carry this out should anger and frighten the hell out of every citizen who lives in this great nation.

What is shows, Nappy, is that prosecutors cannot be expected to act fairly, with witnesses, facts or anything else.

Schiff clearly showed that. So put a sock in it. I don’t trust your legal judgment at all. Not even a little bit.

This man clearly needs to go back to his mother’s basement, and stay there until he can start thinking rationally again. I refuse to watch or believe anything that comes out of his mouth.

Question for the judge: how many witnesses does the SCOTUS cross-examine per year?

In some cases, and an impeachment is one of them, the deliberative body makes a ruling based on the evidence already presented. The House did not do its job, so it isn’t the Senate’s job to do it for them.

Damn judge...where the hell were you. The HOUSE had the witnesses etc.
That was their job.

The Senate didn’t have to do any of that, nor were they in aby way obligated to do so.

As a judge you should know that this was not like a criminal trial in any way.
