Well lawfare is wrong. Sole power to try is sole power to try. There is no appeal from Senate removal, so they are the final authority on how they do it.

Moreover, any court can dismiss a case for failure to state a claim, or can find for a defendant under summary judgment because the evidence presented by the plaintiff if insufficient to prove a case or because the balance of the evidence is the in favor of the defense.
