also, congress is its own controlling legal authority on impeachment procedure. if the procudure is flawed, such as with failure to produce exculpatory evidence, then only congress has the lawful power to remedy the failure. in this case, if the house procedure is flawed, then only the senate has the authority to nullify its effects (the impeachment). the senate should dismiss the impeachment charges, hold the pelosi and the house impeachment managers in contempt of congress, declare them vexatious litigants, barring them from bringing forward any future impeachments for life, affirm that trump is innocent until judged guilty in the full senate of any such charges, and dismiss the charges with prejudice. not to execute full authority to dismiss charges will encourage house democrats to try repeatedly again and it would also set a bad precedent for all future impeachments. then the senate should table permanently the house resolution to ban trump from the office of president (since at that point, to consider passing it would be ludicrous on its face).

i wonder what effect would acquittal have on the potency of any evidence that has been gathered but not yet submitted by the house— i suppose that new and substantially different charges would need to be written, passed by the house and submitted to the senate...

That would be a good thing for the defense to bring up and asked during the Senate Q&A

I agree. Schiff needs to be impeached, convicted and kicked out for good. I have not heard one republican talk about impeaching Schiff.
If it was the other way around, the dems would not be shy about pushing him out of Congress.
Likewise, it is clear the "whistleblower" lied on the complaint form since the phone call he referenced was not at close to the truth. He should be prosecuted for perjury and I'm sure there should be more charges.

Sounds like somebody that the FBI should set up and have a 302 interview with to see if they can get him to “lie to the FBI” so they can “flip him” by threats and blackmail to do their political dirty work against someone in the opposite political part from the current sitting President.
Isn't that what Obama did?

“the senate should dismiss the impeachment charges”
NO!
Trump needs to be acquitted, nothing less.
That will exonerate Trump and is the same of finding him not guilty and COMPLETLY INNOCENT of ALL charges.

Why has Adam Schiff not been expelled from Congress ? Because he is a Progressive Democrat.
The Progressive Democrats hold the majority. For now.
