The Disturbing Dismissal of the Kiddies' Climate Lawsuit

On a 2-1 vote, the Ninth Circuit Court finally dismissed Juliana v. United States, the lawsuit brought on behalf of child plaintiffs demanding their constitutional right to "a climate system capable of sustaining human life." The children, and the environmentalist group Our Children's Trust that's using them as lawfare puppets, were demanding a court order compelling the U.S. government to "swiftly phase out fossil-fuel use" and develop and implement "a national plan to restore Earth's energy balance ... to stabilize the climate system." The way William Yeatman at Cato boils it down: "If the plaintiffs had their druthers a single federal district court judge would become, after the president, the most powerful official in the country."

The majority's opinion (one judge wrote a dissent) correctly recognizes the clear-cut limits the U.S. Constitution places on Article III courts — i.e., "[n]ot every problem posing a threat to the American Experiment can be solved by federal judges ... [so] the plaintiffs' case must be made to the political branches or to the electorate at large."

Dissenting Judge Josephine L. Staton, writing more in the style we've come to expect from activist jurists, believes that those constitutional limits can be ignored, because...well, this is an emergency!

What do you want to bet that one of their friends within the federal leviathan is using grants to funds these lawsuits?

Seems to happen over and over.

That even one Judge sitting in a Federal Circuit ruled in favor of this suit is pretty scary. I have no doubt a day of reckoning is cumming for the Judicial branch which has become a Government within a Government. We have these little Obongo dictators sprinkled all over the country making nation wide rulings against the will of the people and something is going to blow.

All of this anti-scientific rhetoric about extinction and catastrophe resulting from climate change was just noise.

It was obviously false, so nobody took it seriously.

Now people are trying to create policy based on this BS. This will have real-world implications. And it is all based upon lies.

Even if one accepts the false premise that there will be detectable levels of climate change, all of these nightmare scenarios are pure fantasy.

Classic liberal insanity at its finest.
They’ll do anything to get those trillions in new taxes, fees, etc. to fund their highly esteemed, communist agenda.
They’ll even use little kids like this to do it.
Their current “legalized theft”methods are just not providing enough funds to carry out their “esteemed” agenda.
Greedy, evil SOBs want this along with all our IRAs/401ks etc. too.

I need to get a new copy of the Constitution! I just read mine and nowhere and I mean NOWHERE in any shape or form did mine mention climate or climate change!

My guess is it’s due to the nonsense they were spewing years back about oil being made from decayed dinosaurs and other ancient organic matter. It’s a dumb name.

Maybe because they are found, generally, deep underground in sedimentary rock associated with fossils?

There is plenty of evidence that fossil fuels were formed a long time ago.

Coal is often full of fossils.

Then how come when oil engineers go back to oil wells that had been drained dry, they find the wells filled with oil again?
