Now that we seem to be starting to get a handle on the immigration crisis on the southern border, reports have surfaced indicating that President Trump will turn his attention to another thorn in our side on the immigration front. This one doesnt crop up in the news quite as often, but so-called birth tourism is a very real thing and it results in a lot of children winding up with US citizenship even though neither they nor their parents have any legitimate ties to our country. (Some estimates put the figure at 33,000 babies per year being born in this fashion.) California is the home to some of the most frequent offenders, but it happens along both coasts and in Hawaii as well. (Axios)
The Trump administration has a new target on the immigration front pregnant women visiting from other countries with plans as early as this week to roll out a new rule cracking down on birth tourism, three administration officials told Axios.
Why it matters: Trump has threatened to end birthright citizenship and railed against immigrant anchor babies. The new rule would be one of the first tangible steps to test how much legal authority the administration has to prevent foreigners from taking advantage of the 14th Amendments protection of citizenship for anyone born in the U.S.
This change is intended to address the national security and law enforcement risks associated with birth tourism, including criminal activity associated with the birth tourism industry, a State Department official told Axios.
The administration isnt releasing any details of the new rules yet, but this is going to be a tricky maneuver to pull off. The majority of these birth tourists are women who enter the country temporarily on a Class B visa. B-1 visas are issued for business trips and B-2 visas are for tourists. Its unclear how any useful restrictions would be placed on the application process.
Would the application be changed to ask the applicant if they are pregnant, and if so, how far along they are? That sounds like a change that would be ripe for an immediate court challenge from the usual suspects. Of course, any move Trump makes on the immigration front will be automatically challenged anyway, so I suppose that doesnt matter.
I wrote about this subject almost one year ago, asking whether it was time to start cracking down on this activity. At the time, however, I was struggling with the question of precisely what law is being broken and what can be done about it. The groups who have been offering travel packages for pregnant women to do this have been arrested in some large raids, but theyre generally charged with fraud.
Many of these groups are in California and they tend to provide these services primarily to women from China and Russia. But even if you cant find such an agent to help you, its still entirely possible to do this on your own. The fact remains that its not against the law to visit the United States while pregnant, nor is it illegal to give birth in an American hospital while here on a legally obtained visa. But the point is it should be.
This practice is probably more common than some might think. Ill briefly revisit one story that really drove home the crux of this issue for me. One of the podcasts I listen to regularly is hosted by two gentlemen from Australia. Last year, one of them announced that he and his wife were expecting their first child. But when the time arrived, he informed the audience that he would be missing from the show for a few episodes.
He then described how he and his wife were flying to Hawaii at the latest date her doctor would allow it and having their child there. But after the child was born, he wound up being stuck there for weeks while the hospital sorted out some issues associated with issuing the birth certificate. The couple made no bones about what they were doing. This was all done specifically to ensure their son would have joint American and Australian citizenship, but neither of them lives or works here.
The entire situation is a tangled mess. Ill be very interested to see how Trump and his team plan on tackling the issue because, at the moment, I cant really imagine a legal solution that wouldnt involve a constitutional amendment.
There are 1,000 anchor babies born to illegal Mexicans for every one "birth tourist" baby born to rich Taiwanese.
Retroactively stripping people of their fake citizenship would be good too.
But, we are a not strong enough to do that, as a nation anymore.
It is time to end dual citizenship. When a foreign citizen becomes a naturalized American citizen, he swears that he will no longer give allegiance to any foreign country. So how can people hold and use two passports. END IT !
The authors of the 14th Amend.were quite clear that it was not to extend to aliens, legal or illegal.

It looks to me like he is enough to know not to take that on directly with this Supreme Court. It makes us all mad as hell and if you read the intent it was clearly meant for US citizens. So for now he has to hope we get the congress back and get it done through there (another thing squandered when we had all 3). I think he needs to flip 2 lib SC judges to challenge it. It is a fact that every thing that is taken to the SC and lost means a precedent for a decade.
Until the United State can dictate to other countries who they recognize as citizens ... we dont and cant .... then there will always be the possibility of dual citizens.
Currently, the US does not recognize dual citizenship. Either you are a US citizen, or you are not. If a US citizen is recognized as a citizen by another nation, the US does not care.
Well, since the authors are no longer here, others are interpreting what was written. I say that we should make it very clear with an amendment.
Automatic or Birthright citizenship should only extend when one of the biological parents is a US citizen at the time of birth
Earned citizenship should follow the laws for natrualization
In EITHER case, full citizenship rights should only be grated after the age of majority and after spending 10 years as a resident in the US.

We’re basically the last civilized country that has “automatic citizenship at birth”. There was a time when many Western countries had it but,one by one,they figured out they were being scammed so they did away with it.
Each country sets its own laws regarding who they’ll recognize as citizens.It’s pretty difficult for any country to “police” such matters unless the person openly admits it.
Stopping the massive flood at the border was the highest priority, and that’s why he focused on a wall. H1B visas were a second priority, due to scale, but we have some vetting of these people. Birth tourism is an egregious case, but it is smaller in scale and the kids are less likely to use our resources.
In short, I agree with his priorities and how he tackled them.
The Russians and Chinese who are the main participants are rich and do it to provide options for their kids and maybe an exit strategy for themselves.
They're not going to be drawing US social services.
I agree it's not the intent of the authors of the 14 Amendment, but is it really bad for our country to have rich, successful citizens of other countries relocate here?
2. Prosecute those anchor babies who meet filing thresholds but do not file income tax returns.
3. Publicize these efforts, and you will see a lot of anchor babies renouncing US citizenship.

I’m not sure if this is the case. We really need stats to show the countries of origin of the parents of these anchor babies. I will grant that many of them are from as you say, rich Chinese or Russians, but I still feel that MOST are from South of the border.
Yeah, stats are hard to come by, and I'm really talking about organized "tourism" vs. opportunistic birthing because it was easy to cross the border.
It sounds like Saipan is the new hot destination for the Chinese since they don't even require a visa for the first 45 days and confer US citizenship.
