Using Red Flag law, woman files paperwork against CSU officer who shot and killed her son

LARIMER COUNTY, Colo. -- A woman has filed a petition and affidavit for an extreme risk protection order (ERPO) against the Colorado State University police officer who fatally shot her son in 2017.

The paperwork was filed Jan. 9. A judge will hear the case Thursday.

To file an ERPO, someone must meet certain conditions, such as living with or be related to the gun owner.

In the ERPO, under penalty of perjury, Susan Holmes claims she has a child in common with CSU police Officer Phillip Morris.

Holmes told the FOX31 Problems she planned to argue in court that she had a different interpretation of what “have a child in common” actually means.

Susan Holmes' son, Jeremy Holmes, 19, was killed during an encounter with Morris and another police officer on July 1, 2017. Holmes possessed a large hunting knife at the time and body camera footage shows he started running toward the officers with the weapon before they opened fire.

District Attorney Clifford Riedel found the shooting to be “clearly justified.”

In the ERPO, Holmes says Morris "used his firearm to recklessly and violently threaten and kill 19-year-old Jeremy Holmes."

The FOX31 Problem Solvers learned there are a total of five ERPOs filed in Colorado courts so far.

Two were filed in Denver County, two were filed in Larimer County and one was filed and denied in Lincoln County.

On Wednesday afternoon, CSU provided the following comment:

"CSUPD Cpl. Morris is not on leave and continues to serve in his capacity as a peace officer at CSU, and continues to lawfully carry his weapons. He does not share a child with Susan Holmes.

CSU does not share whether an employee has been subject to disciplinary action, as that is confidential personnel information. That being said, as you know, District Attorney Cliff Riedel’s office investigated the incident related to Mr. Holmes and determined that Corporal Morris was justified in his actions and, in fact, took numerous steps to try and deescalate the situation. A link to the letter is here.

CSU believes the letter speaks for itself. Cpl. Morris’s service to our community as an officer since January of 2012 has been consistently honorable and professional."

The law of unintended consequences at work. Because her psycho son got blown away the cop is somehow related to them? Why not seek a court order forcing him to go on Maury's show to see if he's the babydaddy? Better keep my big mouth shut or they'll get more dumb ideas. Now that any whack job can legally pretend to be whatever gender they can pull out of their butts, let's make the definition of relative "fluid".

The cop tried very hard not to shoot the wack job who was charging at him with a large hunting knife, while screaming, “shoot me!” The officer backed up 36 times while recording with his body cam.

If nobody is willing to lock him up in a mental institution, he should be sent to an unoccupied island with food and water and left to fend for himself.

The mother of the psycho son lied on the paperwork.

Any sane person looking at the bodycam footage would deduce that her son was on a mission to get himself killed.

The cop must have backed up at least 50 feet ordering/pleading with the advancing guy to drop the knife.

If anything, the mother should have filed against the female cop that announced she was going for her taser.

That’s when the guy went from advancing to charging the male cop.

It appears the Colorado law requires that some sort of a domestic relationship exist between the gun owner and the accuser. I do not believe this is the case in all red flag jurisdictions.

The hearing was held already. The woman lost. And yes, “child in common” was discussed which exposed the inability of the Colorado Legislature’s (dimbulb Democrats, of course) inability to use words correctly. Thankfully, we had a judge with actual knowledge of the law - and he did a fine job.

Result, the Colorado Red Flag law failed- as expected. Stupidity as usual. Hopefully, we’ll rid ourselves of liberals well for we are exposed to Virginia-level collection of butthole legislators.

Yes, the world is now a safer place for innocent, law abiding people.

“The cop must have backed up at least 50 feet ordering/pleading with the advancing guy to drop the knife.”

113 feet, according to the letter describing the investigation. And the guy was within 12 feet of him, after the officer put up his pistol and was trying to draw his taser, and charged the officer. WAY too freaking close. Officer still managed to draw his pistol and fire four aimed shots, all of which hit. The other officer fired two aimed shots, both of which hit, trying to prevent the officer being killed. Exceptional marksmanship by both officers. SOB wanted to die, SOB deserved to die, and didn’t have the guts to do it himself.

I don’t generally side with cops who shoot unarmed or nonthreatening people, but this was as righteous a shoot as is possible. I’m not a cop, but I’d have shot him long before he got that close!
