Mark Levin: 'Appalling' to watch lawmakers invoke 'unconstitutional' War Powers Act against Trump

Mark Levin declared the War Powers Act of 1973 "unconstitutional" and criticized lawmakers who cited it as a reason to support a similar resolution passed Thursday in the House of Representatives as an intended check on President Trump's power to take military action.

"The War Powers Act of 1973 is unconstitutional," Levin said on "The Mark Levin Show" on Westwood One. The resolution requires a president seeking to engage in military conflict --whether through the declaration of war or "response to a national emergency created by [an] attack upon the United States, its territories, possessions or armed forces"-- obtain the consent of Congress.

Levin said the act, authored by former Rep. Clement Zablocki, D-Wis., was rightfully vetoed by former President Richard Nixon.

I know that this stupid resolution is a meaningless waste of time. But observe how these people FIGHT for what they believe. They will do ANYTHING without even thinking it through. If the conservative side had half the sense of alacrity of the left they’d be eliminated by now.

I’ve gotta know who is cattle prodding these people.

The 1917 and 1941 Declarations of War both say "The President is authorized and directed" to employ the Army and the Navy to wage war,

That seems to me to be the right balance. Congress has the power to raise an army and to provide for a navy. But Congress doesn't get to appoint the Commander in Chief.

Congress gets to declare war, and to direct the Commander in Chief of Congress's forces to wage war. And Congress also presumes in the 1917 and 1941 Declarations that the President, when acting as Commander in Chief, needs authorization from Congress to do so.

States are the other power that is allowed get us into war.

As for a pres, it does say, 'when called into the actual Service of the United States'. Does that mean when only directed by Congress?

In general, when it comes to the military, it is Congress that has most of the powers, they have failed to use such powers to restrict presidents.
