Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside...
Section 2. Representatives shall be apportioned among the several States according to their respective numbers
,counting the whole number of persons in each State, excluding Indians not taxed....
To maintain the original basis of apportionment by residents, the first sentence of Section 2 of Amendment XIV should have been written as:
Representatives shall be apportioned among the several States counting the whole number of persons in each State, excluding Indians not taxed.
Alternately, Sections 1 and 2 could have been reversed to retain the original basis of apportionment by residents, but they weren’t.
Amendment XIV was rushed though despite warning of potential problems.
Yeah, it doesn’t say “citizens”, but “persons”.
Not sure what they wanted.
