What if the House doesn’t send the impeachment articles to the Senate? Idea championed by Harvard Law’s Laurence Tribe garners attention

Some House Democrats are pushing Speaker Pelosi to withhold the articles of impeachment that are expected to be approved by the House Wednesday, an idea that has been championed by Harvard Law School Professor Laurence Tribe.

The notion of impeaching Trump but holding the articles in the House, which could delay a trial in the Senate for months, has gained traction among some of the political left as a way of potentially forcing Senate Majority Leader Mitch McConnell, R-Ky., to conduct a trial on more favorable terms for Democrats. And if no agreement is reached, some have argued, the trial could be delayed indefinitely, denying Trump an expected acquittal.

The gambit has gained some traction inside the left wing of the House Democratic Caucus this week. Rep. Earl Blumenauer, D-Ore., said Wednesday, as his colleagues debated the impeachment articles on the House floor, that he has spoken to three dozen Democratic lawmakers who had expressed some level of enthusiasm for the idea of "rounding out the record and spending the time to do this right."

"At a minimum, there ought to be an agreement about access to witnesses, rules of the game, timing," Blumenauer said of a Senate trial.

Another Democrat, who spoke on the condition of anonymity to discuss internal deliberations, said there is "serious concern about whether there will be a fair trial on the Senate side" and acknowledged active talks about withholding the articles.

The notion has been most prominently advocated by Tribe, a Harvard Law School professor who is a harsh Trump critic and has advised the House Judiciary Committee on the impeachment process.

In a Washington Post op-ed, he wrote that “the public has a right to observe a meaningful trial rather than simply learn that the result is a verdict of not guilty.”

Does not anybody else see what the witch is doing? She is holding onto the articles of impeachment as long as she can to keep implicating President Donald Trump in some sort of crime. She knows that releasing the articles of impeachment would be an embarassment to the democrats. She does not intend to do that. She will hold out as long as we will let her. The time has come to close in on her. Let us expose her for what she is.

For what's worth, Trump has said he wants a trial. He wants vindication. He wants to prove he didn't do what the democRATS in the House say he did.

McConnell has already publicly confirmed within the last week that he is not acceding to any of Schumer's demands and is working in close concert with Trump's WH lawyers in structuring a trial.

He went so far as to declare that he is a partisan in this process. He is partisan for the Republican side.

And in his speech this morning on the Senate Floor, he was not favorable to any of the democRATS demands.

As a matter of fact, he was highly critical of their weak, abbreviated process in the House and had nothing good to say about it.

That's pretty much what McConnell's assessment was.

But he also said that he wouldn't allow the House to "roll" the Senate.

Trump just tweeted this at 7:16 PM this evening:

So after the Democrats gave me no Due Process in the House, no lawyers, no witnesses, no nothing, they now want to tell the Senate how to run their trial. Actually, they have zero proof of anything, they will never even show up. They want out. I want an immediate trial!

The US Constitution provides that “all citizens are innocent until proven guilty”. If the Senate holds an impeachment trial, it can only determine that the president is “not guilty”. If they do not hold a trial, they can declare that he is INNOCENT. The Senate can simply vote on impeachment rules that require the House to turn over the charges and if they do not turn over the charges, he shall be declared INNOCENT.
