Good luck with it. DA is running into the constitution - not only the federal but also the state which has double jeopardy protection.

Are evading state taxes and evading federal taxes the same crime? If not then double jeopardy should not exist.

Separate crimes can be prosecuted. No one may be tried twice for the same crime.
