I actually agree with this... I am so tired of being guilty of something until I explain to someone who has no right to know any of my business other than the one probable cause for the detainment. Language barrier aside, this “everyone is guilty” fishing expedition every detainment has absolutely got to stop.
For an officer with an IQ of about 75 to try and catch someone up on words and replies from BS ignorant questions as probable cause to further the investigation is BS. There is not one “intelligent” person on this board who has not been through this ignorant low IQ crap... The “officer’s discretion” of someone with only the IQ of 75 playing with sneaky words they don’t even understand the definition of is not intelligent “discretion” at all...
I agree with you. I’ve very pro-LEO’s but respect for each other is a two way street and LEO’s often don’t seem to know the basics of what your rights are, or they try to “word smith” their way around them - which is unethical and unconstitutional.
Saying “you’re suspicious so I’m going to investigate and perform a search” isn’t justified unless they can articulate what you’re doing wrong.
I don’t know if many FR’s are aware but there’s a “1st Amendment Audit” movement that deliberately record their interactions with the police. They’re all over YouTube. The number of times the police tell a lie and violate the rights of the citizen is too often. They often go into a public building, like the DMV, and record with a phone or camera. The employees freak out - call the police. Then the police lie that it is against the law. Anything you can see in a public place can be recorded - this is a 1A right. A sign saying “no phone use” doesn’t trump law.
It’s been quite educational watching them.
