Straight from CNN themselves:

https://www.cnn.com/2019/12/03/politics/intelligence-report-phone-records-devin-nunes/index.html

The records, according to Intelligence Committee member Rep. Eric Swalwell, were subpoenaed from third-parties.

The phone records, which are labeled in the report's endnotes as coming from AT&T, show a web of communications between Solomon, Trump personal attorney Rudy Giuliani, Ukrainian American businessman Lev Parnas, Nunes and the White House's budget office. CNN is owned by AT&T.

"Like all companies, we are required by law to provide information to government and law enforcement agencies. In all cases, we ensure that requests for assistance are valid and that we act in compliance with the law," said Jim Greer, a spokesman for AT&T.

“...a web of communications between Solomon, Trump personal attorney Rudy Giuliani, Ukrainian American businessman Lev Parnas, Nunes and the White House’s budget office.”

Stupider and stupider. So what.

Congress has subpoena power without being subject to court scrutiny, UNLESS challenged.

AT&T and other telcoms have billions and billions of reasons to not want to piss off Congress.

But I believe Nunes can still sue over a subpoena not properly predicated.

Still, this is an OUTRAGEOUS abuse and a bridge too far. By seeking only phone records (but if they did this, probably all digital records) they declare this was not done for criminal purposes, properly predicated, but for POLITICAL reasons alone.

Democrats are fully invested now. If Trump is reelected, the DOJ will deliver payback on a scale never seen before. And they may be dusting off those weapons right now.

OF NOTE: Anything the House can do, the Senate can do!
