The FISA courts behaviour would surely come under heavy scrutiny in these proceedings, so there could be a conflict. I do not know how closely the FISA peeps apprise the SC as to their goings on.

I doubt he oversees and approves every action of the FISA judges.

But who's to say they wouldn't reprise the blackmail. "that's a nice daughter you've got there....it'd be a shame if it was learned you broke immigration / adoption laws....

Destroying the character of an R justice is not below dems common decency.
