Sorry I was referring to Code Toad’s citations. You’re correct on Code’s call for criminal proceedings. My point was simply that taking the impeachment irregularities to the courts is likewise a dead end

Impeachment is not a criminal process. It is a wholly political process and their are absolutely no constraints on how the House chooses to investigate. There are only TWO constraints on the House:

1. They need to hold a vote on articles of impeachment and gain a majority.

2. They need to stand for election every two years.

There are no others, and there is no authority over them that can compel otherwise.

True. The only real constraint is their sense of decency. Sadly, they don't appear to have one.

Exactly right.

The vast majority of the population of this country have never even considered the faintest possibility that the ‘news’ media would deliberately lie to effect a desired outcome.

And, that represents the foundation of this country. Not a real solid foundation for continued freedom and liberty for future generations.

The media now realizes there is no longer any need to pretend to be neutral. A very dangerous predicament for the America we grew up in.

I’m not a lawyer, but it seems to me that the only people who would have any legal standing to object to anything the Democrats are doing would be the “witnesses” they are calling to testify. A witness who doesn't want to testify would probably have an easy time defeating one of these phony “subpoenas” if it ever got into a court room.

Absent such a legal challenge, I don’t envision any scenario where a Federal court would be willing to get involved in House procedural matters.

Sadly, you are very correct.

The way it is being (somewhat) portrayed is that no GOP members at all are being allowed behind these closed-door meetings. That's not the case, but I think that is the impression that many are under.

I'm all for the way the dems are doing this because I think it makes them look terrible. And anytime my enemy can destroy or damage himself without me doing anything - well - I'm all for that.

Here's the bottom line: These closed-door meetings will either produce articles of impeachment - or they won't. That will then all be made public and honestly - it won't really impact the vote in the house one way or the other. The constitution is clear: The House has the sole power of impeachment and the majority in the house gets to decide how they are going to do it. So many here do not seem to get the fact that (as you have clearly stated), impeachment is a political issue, not a legal one. The dems will pay a political price for it.

I STILL do not understand why everyone is wringing their hands. Let them do their dirty tricks and let them impeach him...and then let him have his trial and scorch the earth on which they live...unless deep down you all think he really is guilty. I don't and I think a trial for all to see is the best thing that could ever happen and I welcome it.

It takes a full vote of the House to hold anyone in contempt of congress. And even then it requires an executive willing to prosecute in court to exact any penalty whatsoever.

So, yes, every witness and every document turned over is VOLUNTARY.

So, upon receiving an impeachment referral from the House, suppose the Senate judiciary committee votes secretly against putting an impeachment trial to the full Senate?

What about where the Constitution says removal after impeachment and conviction of high crimes and misdemeanors? How is that *not* criminal when it specifically says “crimes?”

“high crimes and misdemeanors” is left deliberately vague and undefined by the Founders.

It’s up to the House to decide whether to indict (impeach) based on any criteria they choose, as they get to define what high crimes and misdemeanors are.

The only constraint on the House is that they hold a vote and that resolution wins a majority.

That’s it.

Nothing else.

And, as for the Senate “trial”, the Senate gets to decide what procedures it employs and there are only TWO constraints on them for removing a POTUS:

1. The Chief Justice must preside.

2. 2/3 of all Senators present must vote to convict.

There is no recourse should that occur. None.

None.
