Precisely, this is the case filed on behalf of NcCabe for wrongful termination and violation of rights. The judge in his termination case has no business telling DOJ what and when as to their separate investigation.

The judge in his termination case has no business telling DOJ what and when as to their separate investigation.

The issue is that the government is refusing to release documents pertaining to the termination case, claiming that they're part of the ongoing investigation. The judge is trying to keep the case before him moving, otherwise it violates McCabe's rights to due process. The judge may sense that the government is just stalling by claiming an ongoing investigation and it may find itself facing a summary judgement in McCabe's favor.
