A judge told federal prosecutors on Monday that they needed to charge former acting FBI Director Andrew McCabe or stop investigating whether he lied to authorities.
Judge Reggie B. Walton said at a hearing that if prosecutors don't make a decision by Nov. 15, he would order the Justice Department to release internal FBI documents connected to McCabe's ouster, The Washington Post reported, citing a court transcript.
“I would send this message to those in positions of authority in the U.S. Attorney’s office and the Justice Department ... that I will not condone further delay,” he reportedly said, adding that the case “is just dragging too long.”
“You all have got to cut and make your decision. It’s not a hard decision, and I think it needs to be made. If it’s not made, I’m going to start ordering the release of information because I think our society, our public does have a right to know what’s going on," said Walton, a George W. Bush appointee who once presided over the Foreign Intelligence Surveillance Court.

He's telling them to sh*t or get off the pot because their endless investigations have gone on too long. The prosecutors don't control the legal case. The judge does.
They have enough now to prosecute him. Why are they dragging this out?
If it's political issues, then that's wrong.
If it's legal issues, then the judges is just telling them to cut to the chase and get on with it.
I don’t know about an order to this extent, but a grand jury has a judge who is in charge of it. In other words it’s not a two part prosecutor and grand jury arrangement, it’s triangular with a judge involved all along, though not present while the prosecutor meets with the grand jury. Frankly I welcome this order. Given the events of the last week I think my previously stated view that the excruciatingly long periods of time that the DOJ investigations are taking would allow the deep state to prepare a massive preemptive or retaliatory counterstrike.
They’ve probably been preparing all along. Perhaps the Ukraine phone call BS is part of their preparation.
The issue is that the government is refusing to release documents pertaining to the termination case, claiming that they're part of the ongoing investigation. The judge is trying to keep the case before him moving, otherwise it violates McCabe's rights to due process. The judge may sense that the government is just stalling by claiming an ongoing investigation and it may find itself facing a summary judgement in McCabe's favor.

IIRC, that would be Deep State Wray at FBI, covering for his partners in crime. These guys answer to Trump, but went rogue a long time ago.
Vacate the SJ. Time to file motion to vacate is one year from entry of SJ ruling.
Eff McCabe. He’s beyond dirty. A lot of dirt is known about him on the street via George Webb’s reporting.
I’m quite sure one way or another, McCabe is going to rot in hell.

McCabe must have told his lawyers that he has had diarrhea for 15 months, and he can’t take much more..
I believe that the judge has had enough of the DOJ game playing. There is many 0bama holdovers in the DOJ who are probably dragging their feet.
But it’s perfectly reasonable to drag out “muh Trump Russia” investigation for near three years...

I was about to ask if there is a case between the DOJ and McCabe before this judge? Otherwise, I see where he has no authority to involve himself in their investigation at all, much less to issue orders affecting ongoing investigations.
Strange times we’re in.
