Isn’t possession 9/10ths of the law?
If the bank accidentally deposited it into their account, isn’t it then theirs?
Having worked in the bank this is almost 100% human error. It is rare for “the computer to make a mistake.
In the small print on every disclosure you get when you open an account (which NO ONE reads) it will tell you that you cannot keep monies deposited in error.
How many of these stories do you need to read to figure out the money is not yours. Stupid people.
It’s kind of like those casinos where someone wins $20 mil at progressive slot machine play, and then the management says “it was a software error” and refuses to hand over the money.
A teller once handed me $1000 too much. I told her but she it was correct. She called me the next morning to ask pretty please that I return it. I promptly did.
There was an episode of the Simpsons where Grandpa Simpson got a check meant for Bart. The dialog went something like this:
Bart: Grandpa, didnt you think it was unusual that you got money for doing nothing?
Grandpa Simpson: I just figured the Democrats were back in power.
Stupid. They had to know it was a bank error and they had no right to that money.
The bank made a mistake, but that still doesn’t justify their behavior.

This is NOT “theft”. It does not meet the legal definition. Their attorney should have them plead not guilty to “theft
and let it go to trial. A skilled attorney would win the case. Prosecutors are really stupid these days.

Yes...the next thing you know, some guy is going to claim a ‘fake’ hate crime (double header- race-lifestyle) and the police will investigate, figure out the guy is lying, charges him with various crimes, says will drop ALL charges but he is liable for the money spent investigating his FALSE CHARGES.
Then, rather than be ‘thankful’ that the serious charges ‘went away’, his attorney will say it is the Police Dept fault for taking him seriously when it was obvious it was a lie from the beginning, so he shouldn’t have to pay.
Don’t laugh, something like that is liable to happen so just because you find 100 thou in your account all you have to say is you either
Knew your husband was getting a bonus
Your tax return was a direct deposit and you really weren’t sure what your refund was
Your company deposits your/spouse check by direct deposit and you figured that raise you put in for may have come through.
OR (my favorite)....
I THOUGHT THE BANK WAS RETURNING ALL THOSE BOUNCED CHECK AND LATE PAYMENT FEES....
What’s really stupid is that they could have turned the money and made a profit on something and then return the money, but instead, they spent it. Very, very foolish.
Kind of like Buck Bundy(dog)getting a credit card.
Interesting. This happened at BB&T Bank, which is pending merger with SunTrust at the end of the year. Some employees working at the behest of pissed off shareholders on one side or the other, setting up events to generate neg publicity to sour the deal?
Legal technicalities to be worked out, but its stupid to spend money that isnt yours. I would have called the bank and suggested a reward.
But I dont have an entitlement mentality and dont think whitey owes me money.
Toward the very end of the real estate boom in 2007. I lived in the SF Bay area.
There was a story about a couple who submitted a fraudulent mortgage application, got approved and bought a house. When the fraud was discovered, before final closing, they were forced to re-sell the house. BUT it had appreciated over $250k in that short time.
Big issue over who gets the money.
I thought this was a conservative forum with mostly honest and moral people.
This fits in with the “entitlement” mentality so many people have these days: “Hey! I don’t care if it was an error. It’s my account, so the money should be mine to keep!”
