One can only use deadly force if in reasonable fear of immediate serious bodily injury. Three kids sitting in a car in a detached garage does not get one there.
Some places, not in Texas.
Here if you do anything that could be considered theft or mischief after dark your ass is grass.
And that’s the law.
Oh, you saw the video? Did the three teens have their hands up? Please post a link to that here if you can! Thanks in advance!
“Three kids sitting in a car in a detached garage does not get one there.”:
Might - if the teens started to get out. And since one of the three ran away, they obviously WERE getting out of the car.
Three teens at night ion my property? Are they a threat? Maybe not. Three coming toward me? Yep.
Need more facts.
I want answers because they have always been there smoking weed in that garage or whatever you want to call it,Jimmy Harrison said. They always have been there, and they always hung there smoking weed in that garage.
Ummm....bad idea, Mr “I don’t raise my kids” Harrison. I have a right to investigate things happening on my property. And if the teens - 17 years old so possibly bigger than the homeowner - do anything more than sit quietly...
Of course: “Jimmy Harrison said his son was getting his life together and, his future was bright. But I feel like it (his life) was took before we could get it together.
Need more facts, but I wouldn’t assume this was a bad shoot. Or a good one.
Not in Texas. Fear of your life or the life of another, that is Texas law. You do not need to be in immediate fear of physical injury. Immediate means you are about to be shot or beat, if you are in your home and thugs are in your home/garage, in Texas you just have be in fear of your life.
