They WOULD NOT be released if they were a flight risk. They might be otherwise released if it’s clear to the judge that they have a lot more to lose by running than staying put...but maybe not, even in that case.
An Illegal, is by definition, a flight risk. Releasing a person like that REQUIRES that the judge be brought up on charges. The fact that we don’t only shows how dysfunctional this country has become.
