Alert tones used in a "Jimmy Kimmel Live!" episode earlier this year to poke fun at a presidential alert test that occurred last year cost ABC $395,000 in fines, the Federal Communications Commission (FCC) said in a Thursday statement announcing a handful of settlements with TV networks.
The FCC said it had settled with the networks for the misuse of the emergency alert system (EAS) tone. The tone is broadcast via TV, radio and other devices to warn of emergencies such as hurricanes and other national disasters.
We remain concerned about the misuse of the EAS codes and EAS and WEA Attention Signals, or simulations thereof, to capture audience attention during advertisements; dramatic, entertainment and educational programs, and at any other time that there is no genuine alert, the agency said in a statement. The FCC may issue sanctions for such violations, including, but not limited to, monetary forfeitures.

Totally stupid. All they needed to do was shift the tones and maybe use a different octave for one of the notes. People would have gotten the point as it would’ve sounded familiar - and it would have been funnier, imo.

I’ve listened to that jingle on YouTube and I can’t believe that the government ever allowed that to be aired. I find it hilarious but, at the same time, kind of creepy.
I despise Kimmel immensely, so I’m glad that he was fined.
At the same time, I don’t know how these various people on YouTube are allowed to create fake EAS emergency scenarios, such as nuclear attacks, because they use the emergency alert tones. But, I admit that I enjoy listening to some of the scenarios. Some are really well done.
It’s amusing that Kimmel was fined while many YouTube users use those same tones in their disaster scenarios and are not fined. It couldn’t happen to a nicer guy.

I was a radio/TV Broadcast Engineer back in late 60’s, early 70’s and we would occasionally play it until word came down from on high that it was a big NO-NO.
Proves that Kimmel’s writers are clueless about technology. Those tones automatically trigger EAS boxes installed at transmitter sites to cut away from the program feed and wait for an emergency message.
Of course the higher-ups at ABC should have caught this.
