DC judge mandates a right to Medicaid for able-bodied adults without work requirements

Republicans have failed to promote a single conservative fiscal reform to even tweak the growing welfare state, despite their promise to fight for welfare work requirements. But at least Republicans at a state level are promoting conservatism, right? Well, not if the courts are crowned king of the republic.

Courts have become the final arbiter of cultural issues and now even border and national security issues. Thus, it was only a matter of time before they ventured into fiscal/economic issues. Recently, several states have been conditioning Medicaid eligibility upon work requirements. Arkansas, Kentucky, and New Hampshire got a waiver from HHS to require that non-disabled beneficiaries under 65 show that they have completed a certain number of hours of work requirements or similar community engagement.

D.C. District Court Judge James Boasberg, an Obama appointee, followed up on his injunctions earlier this year on HHS’ approval of Arkansas’ and Kentucky’s plan for work requirements, doing the same to HHS approval for New Hampshire. Earlier this year, New Hampshire adopted Granite Advantage Community Engagement, a program to require able-bodied adults to document 100 hours of work, schooling, job training, or volunteer work in order to apply for Medicaid.

These judges continue to forget that the role of a court is a shield, not a sword. ... There is no right to Medicaid, . and even if a court were correct in its reading of a law, the executive branch is not bound by its decision to award and appropriate funds.

Conservatives need to think long and hard about the purpose of fighting in politics if we are going to cede this much power to single district judges.

There is no subject that a judge does not feel they have the power to rule on. Watch, the next time a President has to order military action, some district judge will rule that the military must cease operations. Can you imagine today’s judiciary during the Vietnam War?

This has to stop. The judiciary must be restrained. Johnny Robert’s Court can either do it themselves or, I suspect, the citizenry will.

Worse than that, they have failed to even try to make a convincing case to the public as to why the welfare system is hurting us. Reagan did that, and Gingrich did that, but since then, it seems they can’t be bothered.

The Founders never intended that the Judicial Branch could over ride the elected Legislative and Executive, substituting their personal political whims instead. They are out of control.

This why it is very important for Trump to have a chance to get more USSC judges appointed. And if America could wake up then we might get a constitutional amendment to put a stop to this crap.

Congress defines the powers of the lower courts. But fat chance of doing this through the Pelosi-led House.

Boasberg is a tyrant only because he allowed to be a tyrant. What happens if the Governor’s of Arkansas and Kentucky thank the judge for his input, but politely tell him to go f*ck himself? What does the judge do? Does he have a police department to call? Can he call up the National Guard? What happens if the judge issues some type of detainer for the respective Governors and tries to send the FBI or US Marshal’s to take them into custody? What happens when he tries that and the President steps in and calls them off? What happens when the FBI or US Marshal’s show up at the state Capitol buildings, in the respective states, and the State Police are there? I’m not talking about the Troopers that are assigned to the Capitol, I’m talking about the State Police. What happens when the Troopers ask for a copy of the paperwork, tear it up in their faces and tell them to go back to their offices and not come out? Otherwise they’ll be dealing with the ENTIRE State Police.

What happens? I’d really like to know. They only get away with what we let them get away with.

This chit got into high gear when some judge was allowed to rule that a state proposition passed in California back in the 1990s barring illegal aliens to access welfare was invalid because it violated there constitutional rights.

Hello! Aliens illegally present should have NO such rights and the judiciary should be barred from even hearing such cases.

Any judge anywhere can now “declare” monies out of the federal or state treasuries to pay for programs?

can we find a judge that can just declare that none of us have to pay taxes?

There’s no right to Medicaid, as the author says. So how can this even be taken up in judicial court?
