However, in Hillsborough County we have a state attorney (otherwise knows as the district attorney) who would be the one prosecuting anyone charged with a self-defense murder.
Though he isn't a judge, he is a Democrat whose campaign for election was supported by a group called Florida For All, Inc. which contributed $70,000 to his campaign. That's not a conservative organization.
In our case he might as well have been an Obama appointee and I'm willing to bet he would be prosecuting that teenager if the shooting had occurred here instead of Texas.
Hillsborough is one of the few Florida counties which in 2016 went for Hillary.
Sorry you are faced with a DA like that AH. I’ll keep that in mind if I head down that way. Note, the sheriff is the one who would arrest the person so be watchful whom gets that position as they are elected unless they are in one of the cities that has a PD. Once the prosecutor chargesa prelim hearing is set before a judge which is where the SYG law can be applied. In essence according to the law you are immune from prosecution if you fall within the statute so there is no trial and the matter dismissed. Prosecutors like the one you mention hate this law because it removes them from getting to court and slanting the presentation against you all the while running up your lawyer’s bill so even if you are found not guilty at trial, you get socked with a large legal bill. FWIW, in the Zimmerman case, the SYG law was not used. Zimmerman used a self defense plea and was found not guilty. His attorney used that avenue because it was a best way to proceed.
