Trump administration scores win over challenge to asylum restriction

A federal judge decided Wednesday to leave in place a Trump administration rule that imposes restrictions on individuals seeking asylum in the United States if they passed through a third country on their way to the border between the U.S. and Mexico, potentially leading to a sharp reduction in Central American migrants entering the country.

The rule, published in the Federal Register last week, requires people seeking asylum to first apply in one of the countries they pass through on their way to the U.S., with certain exceptions. The rule was quickly met with a legal challenge from advocacy groups, who moved for a temporary restraining order blocking the rule. After a hearing in Washington, D.C. federal court, District Judge Timothy J. Kelly denied the motion. The rule will remain in place for the duration of the case, unless the decision is successfully appealed.

"We are disappointed in the court's decision today," said Claudia Cubas, litigation direction for the Capital Area Immigrants' Rights Coalition.

“District Judge Timothy J. Kelly”

A Trump appointment. In this case, he made the right decision. I presume the matter will be appealed to Circuit Court.

The Left shouldn’t be raising a fuss about this.

This is their precious UN’s rules for asylum seekers. Trump is just ordering that the Immigrations Service apply the rule.

This decision (amongst many others) shows the incredible importance of Federal District Judges. There are currently 126 Federal Judicial VACANCIES which is inexcusable. Let’s pick up the pace and PLEASE HAVE LINDSEY GRAHAM ELIMINATE THE “BLUE SLIP” PROCESS for district judges just as he has for Appeals Court Judges.

Again, PICK UP THE PACE.

AG Barr’s decision is not reviewable by the Judiciary. Says so right in the law. Game, Set and Match.

Is there not a United Nations agreement that says the same thing about the 1st country refugees/asylum migrants enter must apply there first?

Sorry, don't have time to research. Going to see Ted Nugent at a local smallish venue.

While I certainly agree with you, you’d be shocked by how dorks I run across here can’t seem to understand the importance of judges and instead demand that Trump rule by fiat and ignore the rulings that go against him (not having a clue as to just how many Republicans are teed up to impeach and remove him the minute he does so).

And just in time to reinforce the importance of District Judges, an Obama District Judge just came in with a different opinion.

Come on Mitch and Lindsey, fill those 126 vacancies! After next week the Senate goes on a FIVE WEEK RECESS where not a single judge will be confirmed.
