Roberts said Ross wasn’t ‘clear’.

Roberts said Ross had the power to include the citizenship question. In other words, there is no law against it.

But Roberts passed it back to lower courts because Ross ‘failed to give a good argument’ using the VRA and needed to provide better reasoning. In other words, Roberts punted but he didn’t need to. He said clearly Commerce has the power to ask the question.

Roberts decided to play politics.

He knew full well that kicking it back downstairs would cause delays, enough to keep it off the 2020 Census. Roberts was said by prominent Americans to just want to ‘stick it in the eye’ of Trump. What an ass this guy is. He’ll get what’s coming to him when RBG croaks.

But Trump is smarter and faster than Roberts. He dug into the weeds with his Commerce Directors and their advisory panels. He saw immediately that the Apportionment Population is estimable using tested and seasoned methodology backed by verification methods using federal databases.

And Pelosi can do nothing about it because there is no law restricting it.

We can expect some snits from Pelosi’s progressive base to file suit against using mathematical estimation methods which have been used for more than a hundred years. Such a suit would upend the history of the Census. Trump’s lawyers could fight that insanity while allowing Commerce to continue.

In other words, a nuisance lawsuit can’t be allowed to stop the Executive Branch from performing what it has done for more than a hundred years. In such a case, the courts would need to make a new law which they won’t and can’t do The basis of such a nuisance lawsuit would be that Census estimating procedures are discriminatory but there can be no facts to support that. Bringing such a lawsuit at the last minute without factual history would tie up the court’s time but wouldn’t stop the 2020 Census from proceeding.

Trump wins and we win because the groups using illegals to thwart our established conventions are defeated. If Republicans retake the House and hold the Senate, a law can be passed that makes the purposes of the Census clear and meaningful.

The history of the US Constitution addressing the apportionment of representation in Congress is the original Constitution and added provisions called out in the 12th and 14th Amendments. It is clear that Americans born on its soil including Native American Indians who pay taxes, freed slaves, all that have constitutional voting rights (felons omitted), are entitled to have representation in Congress.

The Census and its policies and procedures have always until 2010 under Obama been guided by good and common sense using tested and seasoned methodology.

It wasn’t until 2010 and now 2020 that the leftists are pushing an oblique power grab to stop the American government from counting its citizens.

You don’t think an injunction from a court to halt the process would work? I’m not so sure.
