You are quite wrong on this point. The Apportionment is based on the numbers of persons as enumerated by the Census. That is by law and by the Constitution. The states will determine the boundaries of each district but they must be equal in number to all districts in a state to the maximum extent possible. Everyone, citizens, green visa holders, illegal aliens, inmates, lunatics, etc. etc. count if they were counted in the enumeration. This is one of the reasons that the Democrats have been fighting this issue.

The ‘numbers of persns’ is the key operative phrase. The Commerce Department has a long, long history of dealing with how that phrase is handled. From freed slaves to American Indians who pay taxes or don’t, the Apportionment Population has settled into a definition of who has rights under the Constitution and is subject to the jurisdiction of the United States.

Illegals are not subject to US jurisdiction. They are subject to deportation unless they qualify for asylum. But they’ve learned over decades how to game the system. Their con game is coming to a close.
