Unconstitutional - even stupid Jerry Brown knew it and wouldn’t sign that bill when it came up before. The states cannot add requirements to Presidential elections.

The Ninth Circuit doesn’t know that. They will sign off on anything Newsuiance decides. The question is what will Chief Justice John Roberts do.

Maybe, maybe not. I don’t know of any part of the Constitution that requires a state to put someone on the Presidential ballot. The slave states in 1860 didn’t have Lincoln on the ballot, so it’s a Democrat tradition. Republicans weren’t on the last two California Senate election ballots and write-in votes were not allowed.

And primaries are associated w/parties. Gov can’t dictate to political parties.

The Constitution doesn't cover Presidential elections. It only requires that the state legislatures select a slate of electors to the Electoral College, by whatever means the state chooses. Holding an election is only one possible way. It isn't required. The states have carte blanche to decide how they pick electors. I see nothing unconstitutional about this bill.

It should be obvious however that Trump could refuse to comply and be omitted from the California ballot, and it would have no effect on his ability to win. He is never going to get the California electors anyway.

Where in the Constitution do you find ANYTHING about “Presidential elections”?
