There's plenty of time, this case doesn't need to be settled until Congressional Apportionment is to be done, AFTER the Census is complete.

If Alabama wins it's likely that the Court will order that the President adjust the Census counts to remove illegal aliens before sending the counts to Congress for Apportionment.

This case has will most definitely make it to the SCOTUS.
