Trump Considers Executive Order On Citizenship Question
Axios ^ | July 4

Posted on 07/04/2019 7:38:31 AM PDT by Helicondelta

President Trump is considering an executive order to try to move forward with a citizenship question on the 2020 census, top sources tell Jonathan Swan and me.

"We didn’t come this far just to throw in the towel," said a senior administration official with direct knowledge of the conversations.

Former federal judge J. Michael Luttig, who has longtime ties to officials in the administration, told Axios:

"If the president of the United States were to issue an executive order, supported by his full Article II powers, directing that the citizenship question be included in the 2020 census, I believe the Supreme Court would affirm the constitutional power of the president to include the citizenship question in the census.”

Obama didn’t remove the question, it was removed in 1950. Before Obama was even born.

I had to look this up a few days ago because I couldn’t remember the time frame.

The question of citizenship was first used in 1820, dropped in 1950. It is still used in the yearly American Community Survey.

"The only question is would Congress impeach Trump were he to do so?"

They didn't impeach Andrew Jackson...."John Marshall has made his decision, now let him enforce it"

“So you people in CA, NY, IL, and maybe some others - don’t bother with the Census.”

Here’s a list sorted by house seats.

Wish Bush would have appointed Luttig instead of Roberts. The many gifts of the Bush clan continue to haunt us.

The great part of this is that the Lib judges, in their feverish desire to Resist, are hamstringing future executive action by Lib presidents. This is a win win situation. Trump wins or a future liberal president loses.

Now Trump needs to have his army of beaurcrats start issuing right leaning policy decrees that lib judges will rule against.

Ignore the rhetoric from Trump and the Tweets because they are a very deliberate freakish side show. The real game is forcing a return to constitutional order whereby the office of the president executes clearly defined laws as written by Congress. No more vague laws with spurious interpretations by government agencies upheld by a pliant court system when it supports the lib/prog agenda.

The next lib/prog president will find it much harder to rule by decree.

See too, the text of the constitution ...

The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.

Title 13 of US Code: Census <- there's the "by law direct" stuff

Yesterday Rush was talking about a movement for ALL California conservatives and Republicans to throw away their census forms and do not answer any of them.

The idea being that California democrats want to count millions of illegal aliens to get more seats in Congress and more federal dollars that a big population acquires.

If millions of conservatives don’t even answer, then California cannot count them as part of the overall population, thus losing seats and $$$.

It might be the last defiant act against the far left judicial-political system before outright civil war.

“Citizens, however, can refuse to comply if the question isn’t on the form.”

... and red states get less representation? No thanks.

That will likely be stopped by judicial tyrants, too.

Trump should just send out only the long version of the census. It has always had a citizenship question and has never been ruled as unconstitutional. Forget about the community survey entirely.

Anyone else tired of Trump threatening to do something instead of doing it? Since he must know it gives the opposition time mobilize and prevent the action one might conclude it’s an empty threat to begin with.

Its actually better if Republicans in blue states refuse to be counted. Eventually, the states will have to redistrict based on the new numbers. They will balance their districts to garner maximum democrat seats based on the new numbers. But now, the unaccounted for Republicans WILL turn out to vote, and should be able to swing some districts, because they went stealth during the census. They just have to remain uncooperative in the follow up surveys.

Dear President Trump: Please don’t just talk about this, DO IT NOW!

Agree.

"Trump Threatens to Close the Border."

"Trump Says ICE Will Begin Rounding Up Illegal Migrants Next Week."

"Trump Signals He May Declassify FISA."

Yada, yada, yada.

“Federal law provides that anyone who refuses to answer or willfully neglects to answer any of the questions in connection with any census or survey shall be fined a maximum of $100, or a maximum of $500 if the person gives false information.”

Enforcing infractions is another thing altogether.

Actually all Dems should be encouraged to boycott the census. They don’t like the country, they need to refuse to be counted.
