The 9th Circuit Court of Appeals on Wednesday upheld an injunction barring the Trump administration from repurposing approximately $2.5 billion in Pentagon money to the Department of Homeland Security to build a border wall with Mexico, prompting the White House to promise an immediate appeal.
A divided three-judge panel on the appellate court agreed with a lower court ruling that prevented the government from tapping Defense Department counterdrug money to build high-priority sections of wall in Arizona and New Mexico.
In February, Trump ended a 35-day government shutdown after Congress gave him far less than he wanted. He then declared a national emergency that the White House said would free billions of dollars from the Pentagon.
In its ruling, the 9th Circuit panel noted that Section 8005 of the Department of Defense Appropriations Act of 2019 "authorizes the Secretary of Defense to transfer funds for military purposes if the Secretary determines that the transfer is 'for higher priority items, based on unforeseen military requirements' and 'the item for which funds are requested has [not] been denied by the Congress.'"

In all of the lawsuits and legal actions to block wall funding, I always remember that the House was under the control of the Republicans and Paul Ryan could have worked with Trump and McConnell to pass legislation to fund the wall. The nearly complete thwarting of the border wall is every bit the fault of establishment Chamber-of-Commerce Republicans as much as it is the fault of Democrats.
Not to mention, 2 or the three on this panel were Bush appointees.
The Obama judge voted against the wall and the Bush judges split 1-1.
There is a solution: Hang these judges from the walls they didn’t want built. Pay for the hanging by divesting the judges properties.

The order was signed by Judges Richard Clifton, appointed by President George W. Bush, and Michelle Friedland, an Obama appointee.
Ninth Circuit Judge N. Randy Smith, appointed by President George W. Bush, dissented.
Smith accused the majority of creating a constitutional issue where none previously existed.

Yeah, Mr. Congeniality would nominate a jurist loved by all and blue-slip approved. It is imperative we hold the Presidency and Senate. The leftist infested courts are almost as dangerous to our republic as an Obama clone.

The court system should stay out of politics and stick to criminal law ONLY. Their interference is beyond acceptable.
