It can present its rationale to the lower court, the lower court has to review the rationale in light of the holding in Commerce, and the agency can print the forms. It might be January 1, but it can do it, if the Secretary of Commerce says to the agency, we are going forward with this, the question will be on the form.

That’s pretty much where I am at, unfortunately. These Justices are no better than the useless US Senators who confirm them. I suppose that is not a coincidence.
