If the defense can establish that the accused/convicted was the target of illegal surveillance, the accusation/conviction cannot stand up to a Supreme Court review.

Conviction has to be “clean”. Illegal surveillance will dirty the conviction so badly that they will see his rights were violated and he goes free.

FARA is a federal law that requires people who advocate on behalf of foreign government to register. Failure to do so is the pretextual crime.
Based on this pretext, the government can obtain a search warrant that will NEVER see the light of day. These are FISA warrants. FISA stands for "Foreign Intelligence Surveillance Act." This act was passed to create a court to "oversee" government surveillance aimed at foreign intelligence (not crimes, but spies) - before this, (and as a matter of Con law), no warrant is required. But the public was getting uppity about the "no warrant" thing, so Congress created a law to provide the appearance of oversight, then shrouded the oversight in complete secrecy.
Another attribute of FISA is that when a warrant issues, the snooped has a defense to snooping without adequate predicate or justification.
Combining FARA and FISA, the government creates a paper trail that totally immunizes bad actor snoops from accountability under the law.
All by the book.
Congress enbaled the bad actors and by operating as a "closed club," is not offended when the law is abused to keep the club closed.

There is another wrinkle to this, the use of private contractors to create plausible deniability. The contractor filters the snooping so only the better material is circulated back to the political machine.

this wrinkle could be very interesting if the “contractors” turn out to be CrowdStrike &/or Fusion GPS.
The transcript is actually fascinating reading. The pessimist might see Sullivan’s attempt to be so transparent, then sending the real issue — access to classified data — to a information security specialist, as a way to let someone else do the dirty work. I see it from the optimist viewpoint, that Sullivan was making a major statement to the Government that access shall be provided and sunlight was coming to town. The government obviously wants to limit the case to the counts of lying about the calls with Kislyak, and exclude all the material used to blackmail Flynn into pleading to a lie.
Were I Sullivan, I’d find a way to drag FBI agent Patienka (sp?) into court, put him under oath, and force him to answer questions about his 302’s, recordings of the calls, how they happened to be recorded, where in hell they are now, etc. Surely the new lawyer will get around to that some day.

Huma & doug band were basically “bird dogs” used to sniff out a mark willing to pay up for inside informstion or classified informstion or gummit favors.
The “Foundation” skam took gummit influence & asset peddling to a new level in the history of political corruption.

The ball is in President Trumps court. He can authorize declassification of documents and expose them to the public.
