After following how SCOTUS functions for quite a few years, their docket is established and overflowing. There’s only one SCOTUS and ten’s of thousands of cases applying to be heard. Although everything was dropped instantly for the 2000 election rulings with FL.

Exactly. Rulings like this are exactly why I am not counting my chickens just yet on new “Trump judges.”
We all thought that when he got elected in 2016.... his own party has stabbed him repeatedly in the back. I don’t see them changing- unfortunately. I don’t see how we can get the damage done to this country undone..... it will take 150 years to undo the damage.
I don’t understand why there is a court issue here.
DACA wasn’t legislation, it wasn’t a Zero EO, it was policy from Zero’s DHS - a policy memo. New President, new policy, new DHS director, new memo (Someone posted Trump’s memo!)
And yes I know everything Trump does will end up in federal court so whose pushing this court action us or them?

How is it that this is even in the courts? It was a patently illegal act by EO at its inception. The Courts have NO jurisdiction over the president ending it or enhancing it by EO unless they move to declare DACA illegal which it was/is. It is as if at the trial of a bank robber the Judge were to declare that particular robber’s robbery to be Legal and any attempts to recover the loot to be ILlegal. If Trump were to issue the precisely same EO it would get an injunction against it by the same judge. Legality depends now on the identity of the person doing the deed.
President Trump should say that since the DACA case is unimportant to the Supreme Court then he will ignore the injunction as a current president is not bound by the Executive Orders of of the previous president.
Agreed. The court either recognizes the EO order or it does not. Zero’s EO simply stated his administration was asserting their authority as it comes to prosecutoral discretion. President Trump’s EO simply rolled back Zero’s EO. POTUS should issue a new EO defining that the federal statute would apply to all immigrants as there will no longer be a deferral from prosecution. Simply stated, the law will be applied as written.
So an Executive Order by one president cannot be undone by the next president?

That is correct; if the sitting president undoing the capricious order of Democrat president happens to be a Republican. But not if its the other way around.
