Looks like the man is being charged under the unconstitutional NY SAFE ACT. Could be a good test case for the 2nd circuit which is about to flip pending confirmation of a couple of Trump judicial nominees.

Mark Wolber, Stolarczyk's attorney, explained what's next for him:

He was released in his own recognizance and that is an indication to me that the district attorney's office realizes this is not a dangerous person."
