Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States."
"I think Treason is an accurate term."
I haven't yet read enough where it is theorized that the coup plotters levied war against the U.S. or gave aid and comfort to its enemies. However, the plotters attempted an overthrow of the U.S. Government and it involved members of U.S. Intelligence agencies, Law Enforcement agencies, personnel of Foreign Governments, and members of the U.S. Media.
My reasoning is that the combination of all these entities and personnel constitutes "enemies of the United States." What they did would constitute an act of war had the participants been agents of/for foreign governments. I have to believe that when all is considered, this really was Treason, and it is justifiable to use Military Tribunals and firing squads.
Read about the Burr trial! - Chief Justice John Marshall set the treason bar very high.
Doubt when Trump calls “Treason” he is suggesting death penalty. If asked he will say jail time.
He will be asked by the press if he wants those committing treason to get death penalty
