Good observation - one I have not heard people point out before.
On the other hand - and an equally important but equally subtle point - did you notice the actual phrase is “ life, liberty, and the pursuit of happiness...”
Life is absolute. No qualifiers. No exceptions.
Liberty is absolute. No qualifiers, no if, and, or but’s or foulmouthed “only if the government approves of your happiness”
But you only have a right to “the pursuit of happiness”.
You have NO RIGHT to "happiness".
