That sounds exactly like what's going on in Indiana. We enacted a tax on fuel last year, maybe two years ago, I believe--the tax money generated was supposed to go to road improvements. The stretch of I-69 referred to in this article is an abomination. It's like the road's been carpet-bombed. It's not the only one.
Diversion to public pensions, maybe?

I’m ready to do the same. One of the apparently lawful operations of government is road maintenance. If they completely neglect it, then it means they are focusing time and our tax money on other things. We pay for roads. Sue them? I’m in.
I broke an axle in a pothole and sued the county in small claims court. The county’s defense was “assumption of risk”: I had assumed that risk voluntarily just by using the road. The judge agreed with the county and found against me.
Need to do the same thing in Oklahoma. No freeze thaw cycle excuse to be made here though. Just lousy road maintenance. Wasteful and inefficient.

Potholes on a freeway!!!
There is enough money to pave them with gold yet there are potholes.
I run over one in the right lane on hwy 101 heading to work in Westlake Village, CA that will be filled in then soon after a depression forms then the pothole starts forming again because they use a cold patch. On a freeway where people are driving 70mph or more.
