Not Surprising: Ninth Circuit Delivers A Blow To Trump Administrations Crackdown On Sanctuary Cities

The Ninth Circuit Court of Appeals on Thursday upheld a lower court decision that ruled said sanctuary cities do not conflict with federal immigration laws. The decision comes after the Trump administration challenged multiple aspects of California's sanctuary city designation, which protects illegal aliens from Immigration and Customs Enforcement (ICE) agents.

From the Times of San Diego :

The U.S. 9th Circuit Court of Appeals upheld Senate Bill 54 , otherwise known as the California Values Act, overriding the federal government’s assertion that it violates the Constitution’s supremacy clause that states federal law preempts state law when the two are at odds.

The court also upheld two other laws named in the suit, AB 103 and AB 450 , which allow the state attorney general to limit expansion of immigration detention facilities and require employers within the state to tell workers when their citizenship may be inspected by federal officials, respectively.

"SB 54 may well frustrate the federal government's immigration enforcement efforts," the court said. "However, whatever the wisdom of the underlying policy adopted by California, that frustration is permissible, because California has the right, pursuant to the anticommandeering rule, to refrain from assisting with federal efforts."

Those who champion California's refusal to cooperate with ICE were happy with the decision.

“This lawsuit against California was an affront to our state’s efforts to strengthen public safety for all while protecting families from the president’s abusive and overreaching deportation force,” San Diego Immigrant Rights Consortium Chair Lilian Serrano told the Times of San Diego.

When the lower court ruled in the state's favor, California's Democratic leaders made it known they refused to cooperate with ICE.

"CA will not be complicit in the Trump Administration's attack on immigrations, and we won't back down in defending our people and our values," California's former Gov. Jerry Brown (D) said in a statement. "This Administration has intentionally separated families at the border, confined immigrant children to jail cells and blocked every attempt to shine a light on conditions at federal immigration detention facilities. Today's ruling is a victory for our state and a defeat for the Trump Administration's war on our diverse communities."

There are now counties and towns that have voted to be 2nd Amendment Sanctuary areas...so now it will get interesting. Judges keep upholding the sanctuary for illegals so how will they say an area can not be a sanctuary for the 2nd Amendment?

So when Arizona tried to actually enforce federal law, they were smacked down by the courts. Now suddenly the locals can contradict federal law. We no longer live in a society ruled by law. Only by politics.

Good point.

Here in WA State we have a jerk for an AG named Ferguson who has come out and told many County Sheriff’s they have to enforce a gun grabbing initiative that passed last Nov.

Some Sheriff’s say they won’t enforce it because it’s unconstitutional so it’s going to be interesting to see the outcome, I’m betting the Sheriff’s win.

Yet we have illegal alien sanctuary cities and counties he doesn’t give a hoot about.

I don’t think that anything like that is in the offing! But we do need RBG (86) and Breyer (80) to leave by whatever means “suits” them. And personally, I’d like to see Trump replace both Thomas (70) and Alito (69) assuring us a Conservative majority for another 30 years. Thomas and Alito would show their patriotism by electing to retire while Trump Is President. I guess there’s no real hope for Roberts since he’s only 64 but then we can hold out some hope that “the wise Latrina”(64) has a problem with her type 1 Diabetes and has to leave the Court early!
Trump’s goal should be to “Rat Proof” the SCOTUS for posterity. Probably his greatest “gift” to our country.

I am sure they would have ruled the same way for sanctuary cities for escaping federal rules for gun control, environmental laws, affirmative action, gay marriage and letting men pee in women’s bathrooms...

Maybe Califurinia won't but, having set the precedent, maybe it opens the door for states populated by sane people.

I’d like prolife sanctuary cities then.

Also probiblical marriage sanctuary cities.

In these cities, federal laws protecting abortion and homosexual behavior are ignored. I could go with that.

But it’s never a level playing field is it.

I can get fired for being personally against sodomy or murder. But I can fire anyone because they are for these things.
