Despite the hate crime hoax charges against him being stunningly dropped on Tuesday, “Empire” star Jussie Smollett may not be out of the woods just yet.
An investigation into a death threat letter the actor supposedly received prior to the alleged Jan. 29 attack has been handed over to the FBI, Chicago Police spokesperson Anthony Guglielmi told Fox News.
Smollett initially had been suspected as the source of the letter.
“The U.S. Postal Inspection Service is working closely with our law enforcement partners on this investigation,” the U.S. Postal Service said in a statement to Fox News. “We are unable to provide any additional comment at this time.”
Chicago cops previously said Smollett allegedly resorted to staging the "bogus" attack after the threatening letter he sent himself at his Chicago Fox studio two weeks earlier didn't garner enough attention.
"If he mailed that threatening letter to himself by using the post office, he engaged in postal fraud. That's five to 10 years in jail — that's three times what he's facing for filing a false report if the feds want to go there," Fox News legal analyst Judge Andrew Napolitano said.

Juicy, how’s that jump you just made from the “Crook County Frying Pan” into the “FedGov Fire” gonna work out for you?
I read at one point that this guy is so stupid that he did not get rid of the magazine that those letters were clipped from. And the cops have the magazine.
It’s not a federal offense to mail a hoax threat to yourself.
It’s not a crime to make false reports to the news people.
It is a crime to make a false report to the police. Each jurisdiction has its own laws for that. Smollette made no report to the FBI.
Feds might bring a case to save face, but it’d be a waste of resources.
Upside of all this is the public learns an important lesson. You get the justice you pay for. High and mighty get special treatment. This should not be a shock, it should be common knowledge. When the system operators tell you justice is blind, they are lying, pure and simple.
I wouldn’t be surprised if Kamala Harris’ fingerprints were on that letter.
The FBI has a chance to clear their name.... let’s see if they do that ... or if they play ‘kiss liberal elite butt’ for a few more years of disgrace.

I think that the powder kicks it up another level. The intent of the powder is clear. Smollett was not the only one affected by that. And I believe their are federal anti terrorism laws that will kick in. But we will see.

If he had mailed a threatening hoax letter to himself, and never told anyone about it, no harm no foul. But, he used a letter that he sent through the mail as false evidence of a false report of a crime. In other words, he used the U.S. Mail to perpetuate a hoax, and THAT is mail fraud.
