I am confuse how the justice dept. can say OCARE is unconstitutional after the SCOTUS said it WAS constitutional??? John Roberts TRAITOR!!!
I'm assuming that is sarcasm, but if not... Roberts said the ACA's individual mandate was a constitutional because the penalties for not having insurance were a tax. Congress passed a law killing the penalties, aka taxes in 2017. A Federal Judge in Texas ruled that Robert's lifeline to constitutionality (the tax) has been severed, therefore the ACA without the tax is now unconstitutional. So, on to the 5th Circuit, the most conservative of the Circuit Courts, where I'm sure severability will be the key. Then it will be up to Roberts again.
