Preckwinkle Defends Foxx's Behavior as FOP Demand a Federal Probe

Mayoral candidate Toni Preckwinkle defended her political protégé on Tuesday amid allegations that State’s Attorney Kim Foxx acted inappropriately when she tried to persuade Chicago Police Superintendent Eddie Johnson to transfer the investigation of Jussie Smollett’s claim of being the target of a hate crime to the FBI.

“Kim Foxx was my chief of staff for … a little more than two years. She ran for and was elected state’s attorney. I’m very grateful for the good work that she’s done there,” Preckwinkle told an unrelated news conference on the West Side.

“I think that she makes the decisions that she believes are in the best interests of the office.”

The Fraternal Order of Police has demanded a federal investigation of Foxx’s behavior in the Smollett case.

The Fraternal Order of Police (the police union) is seeking a Federal investigation of the Cook County State's Attorney for intervening in the Smollett investigation on behalf of the accused hoaxer.

Not the type of news that will boost Preckwinkle's prospects in the upcoming Chicago mayoral election.

How does trying to offload a case to the feds involve the 'the office?'

Second City Cop has an interesting take: that Preckwinkle is toast, knows it, and may have a visit from the Feds in store in the very near future.

It is entirely possible that Foxx's office may have violated federal laws that might include, but not be limited to:

<><> Title 18 U.S.C. §1341, Mail Fraud, 18 U.S.C.§1001, Presenting a False Document to an Agent of the US Government for funding (may involve several felonies and could include forgery);

<><> 18 U.S.C.§1027 False statements and concealment of facts in relation to documents required by ERISA enacted 1974 and other possible offenses including civil and/or criminal RICO violations.

<><> 18 U.S.C. §§1961-68 (RICO Act)18 U.S.C. §1001 (making false Statements to Agents of the US Government,

<><> 18 U.S.C. §241(Conspiracies Against Civil Rights). Violation of Civil Rights under Color of law and conspiracy. Conspiring with others to violate 4th amendment rights.

<><> Possibly full investigations centering on RICO conspiracies under 18 U.S.C. §1962(c) could be warranted because (1) the persons (2) were employed by or associated with a public enterprise (3) that engaged in or affected interstate commerce and that (4) the persons operated or managed the enterprise (5) through a “pattern” (6) of racketeering activity, and (7) the taxpayers were injured by reason of the “pattern” of racketeering activity.

<><> Alleged Offenses could include Violation of Rights – which prohibits in relevant part, “two or more persons (from conspiring) to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District

<><> Title 18 U.S.C. §2 41 – Conspiracy Against Constitutional mandates in the free exercise or enjoyment of any right or privilege secured by the Constitution or laws of the United States, or because of having so exercised the same . . .” See, 18 U.S.C. §241.

Under some state's laws governing “fraudulent practices,” it is a third-degree felony to “knowingly and willfully ...
make or use any false document, knowing the same to contain any false, fictitious, or fraudulent
statement or entry” connected to a criminal investigation.

Preckwinkle? Cmon! This is from the Onion right. Nobody would keep a name like that. And a far as the Smollett hoax goes Here's my post here at Free Republic the minute I finished reading the original story:
