That’s why solid red states like Montana better get the message when voting in Democrats, guys like Tester aren’t blue dog Zell Miller type conservatives. When you vote for them you’re putting the judicial checks and balances in jeopardy.

When Andrew Johnson was President, the Radical Republicans reduced the size of the Supreme Court so that he would not be able to fill any vacancies (those already on the Court were not affected).

The Democrats could try that if Trump is re-elected, but they would have to control the Senate to get it through Congress, and President Trump would be able to veto it. It's very unlikely that the Democrats plus Never-Trumper Republicans would have two-thirds of both houses of Contress.
