Today is Texas Independence Day. You might be already in full celebration mode, plunging candles into pints of Blue Bell, swigging Pearl in a can and picking beans out of chili. If so, carry on, you’ve got this.
But if you’re the sort who of person who passes by an elementary school and you are all ... “wait, IS that Texas flag upside-down?” Read on, we are here to help.
1. HOW DID WE GET HERE?
In the late 1820s, Mexico looked north and realized that Texas was filling quickly with armed white men who did not intend to speak Spanish, convert to Catholicism or submit to Mexican customs or taxation. Mexico sent its troops north and made a push to bring Texas back under control. Too late. The Texas Revolution began in Gonzales in 1835 and ended in San Jacinto in 1836.
TEXAS REALLY WAS A COUNTRY?
Absolutely, this was not something we made up. From 1836 until statehood was granted in 1845, we were the Republic of Texas.
3. WE CAN SECEDE IF WE WANT TO, RIGHT?
Former Supreme Court Justice Antonin Scalia spelled it out in 2006: “If there was any constitutional issue resolved by the Civil War, it is that there is no right to secede.”
4. BUT WE CAN BECOME FIVE STATES In the annexation of Texas by the U.S., it was agreed that Texas could divide and reform itself into as many as five states.
5. JUST HOW BIG IS TEXAS?
Texas is the undisputed heavyweight of the lower 48, big enough that you could fit the 10 smallest states alongside the runner-up California inside its borders ... with room for an extra New Jersey.

#1 not correct. Santa Anna’s army had put down uprisings in other Mexican states prior to Texas. White men were not singled out, freedom was.

I believe this was settled by Salmon P. Chase in 1869.

Remember, Chase, while Sec of Treasury in the Civil War,declared greenbacks to be legal tender. Then when he became Chief of the SCOTUS, declared only Gold and Silver were legal tender.
Scalia is wrong about that. Texas treaty entering into the Union did indeed give them that right, in writing. No other state has such an arrangement. Also, the Civil War did not decide whether or not secession was a right. The Civil War only decided whether the side against secession was militarily more powerful. I’m surprised that such an uneducated statement came from such a good jurist.
How are Spaniards not white?
Sorry sport that case decided nothing. It’s one minor case, on a peripheral issue. But ultimately there was a treaty between Texas and the United States. In that treaty one of the specified Provisions was that Texas could indeed leave the union.
A treaty becomes constitutional, and it’s plain language is not subject to overrule. Especially by a court for years after the Civil War.
I rarely disagee with Justice Scalia, but his opinion on secession is illogical, since secession is by definition extralegal.
How are they not white? Mostly by a combination of Moorish occupation for a few hundred years. This was followed by a few hundred years of aggressive interbreeding with the natives of Mexico.
Also, Texas was at war with Mexico, not Spanish people. Santa Anna was not a Spaniard

Also it’s strikingly absent from the Constitution that somebody joining has signed a suicide pact and must remain forever. The Constitution clearly spells out that powers not specifically enumerated to the federal government are reserved for the states. Succession is not discussed. Scalia was simply incorrect and was speaking as a politician at that moment, and not as a constitutional strict constructionist.

During my visit, a group of school children came through. I was glad to see that these kids were being taught about their state's heritage, something that doesn't always happen in public schools today.
Looks like the Frito Bandito to me. And in northern Europe he would be instantly recognizable as not one of the locals. Spain has a lot of North African and Arab blood in them. It’s also where their violent nature comes from.
#4 not quite accurate: We already divided up to encompass Texas along with parts of Oklahoma, New Mexico, Kansas, Colorado, and Wyoming.
All those lovely Ski Resorts in Colorado (Vail, Steamboat, etc.)?
They were in the Republic of Texas!
If you drive from Houston to Los Angeles, you will still be in Texas at the half way point of your trip.
