and not “person” when it come to
interpretation of the 14th amendment.
Agreed. Excellent point. One which I felt would come up in further discussion, if any.
Now...a definition seems to be in order. Which definition would fit the 14th?
Jurisdiction: Noun
- The official power to make legal decisions and judgments.
"federal courts had no jurisdiction over the case"
- the extent of the power to make legal decisions and judgments.
"the claim will be within the jurisdiction of the industrial tribunal"
- a system of law courts; a judicature.
"in some jurisdictions there is a mandatory death sentence for murder"
- the territory or sphere of activity over which the legal authority of a court or other institution extends.
The way I interpret the 14th, the last example seems the most appropriate given that the Constitution was a pact between the geographically dispersed states that existed at the time and formed the Unites States of America.
