Separate lawsuit per the attorney
They did file suit against Phillips. But imo that isn’t for the cash (since he has little) but rather to get him on the record, as a defendant to turn on the media; to get his testimony, find out what news organizations contacted him and what he says he told them etc and compare it to what the news agencies reported and which parts they investigated or verified and which parts they made up or exaggerated.
It would probably be an important part of proving malice to find out that Phillips only said X while CNN reported that Phillips said XY&Z happened. Also to find out which news agencies just ran the story without contacting anyone!
