Maybe he’s using one or both of these laws for authorization:
10 U.S.C. § 2803 (Section 2803) provides that the secretary of Defense ‘may carry out a military construction project not otherwise authorized by law’ upon determining that (1) ‘the project is vital to the national security or to the protection of health, safety, or the quality of the environment,’ and (2) ‘the requirement for the project is so urgent that’ deferring the project ‘would be inconsistent with national security or the protection of health, safety, or environmental quality.
10 U.S.C. § 284 (Section 284) provides that the secretary of Defense ‘may provide support for the counterdrug activities or activities to counter transnational organized crime’ of any law enforcement agency, including through the construction of roads and fences and installation of lighting to block drug smuggling corridors across international boundaries of the United States.
Work already contracted in previous budget.
My suggestion (can’t get my Representative or Senator to listen):
1. Declaring an emergency will generate expected court challenges and other hysterical road-blocks from the left.
2. The president, as Commander-in-Chief, orders the Army Corps of Engineers to use existing and budgeted operations and training funds to build the wall.
3. The Corps of Engineers trains all the time as they build various projects. . .so instead of building semi-useless training projects, they build the wall.
4. Once the Corps of Engineers starts building the wall, the left will be caught flat-footed as they can’t stop the president from exercising his power as Commander-in-Chief.
Do it now because the dems occasionally make noise about inserting language in the defense authorization bills prohibiting use of Corps of Engineers to build the wall.
It WAS authorized in 2006.
