Something does not add up. Abortion advocates fear nothing more than a reversal of Row v. Wade. Yet they are pushing legislation that is obviously going to be challenged in the courts. When laws like the new NY bill work their way to a slightly more conservative leaning court, they will almost certainly be struck down and could easily take Row v. Wade down with them. So it is the left who truly are the instruments of Row v. Wades destruction.
It is either because they are just plain evil, they are insane and unintentionally working against their own agenda, or they are hoping to energize their base just before the next election by blaming Republicans if their own ill conceived and legislation results in new restrictions against abortion. Take your pick... their is a good chance that there is an element of all of these alternatives in their motivation.
That would take an entirely separate legal action where SCOTUS would have to rule abortion in toto was *illegal* on a federal basis.
Clearly, that is not the case, since the constitution is silent on the matter. And please don't introduce protection of life, liberty ...; that simply falls into the old circular debate.
What's going to happen is Roe will be overturned, and the matter will return to the states. Some/most/all will pass individual laws, like NY. The next stage will be the legality of various stages ie 3rd trimester. Ultimately, scientific input will render stages of viability, and we'll essentially be back to the 1-2-3 rule of thumb.
That is assuming there is someone in New York who will challenge it and a judge that will overrule the law.
